Floorguard Products Limited Warranty
Floorguard Products is proud to offer a Limited Warranty on its products when installed according to Floorguard Product’s instructions and specifications.
What does this warranty cover?
Floorguard ("Seller") warrants that its products ("Product" or "Products") are covered by the following Limited Warranty when installed according to Seller's most current published installation instructions, specifications, and product data sheets. To be eligible for warranty coverage, 4 pictures of the product used, 4 photos of the alleged issue, and the lot number for each product used from the container must be fully submitted within thirty (30) days of installation to your sales representative via email correspondence.
The Seller warrants that the Products will be free from manufacturing defects and will perform in accordance with the Seller's published product specifications for the duration of the applicable Warranty Period, subject to the terms, conditions, and limitations herein.
If, during the applicable Warranty Period, a Floorguard Product fails due to a manufacturing defect as determined to the Seller's satisfaction, the Seller will, at its sole discretion, either replace the affected Product or issue a credit or refund for the original purchase price of the defective Product. This Warranty is limited to the replacement in-kind of materials determined to be defective or the value of such materials only.
This limited warranty is non-transferable and applicable only to the original purchaser of the Floorguard Product(s) and the owner of the property at which the Product(s) are installed at the time of purchase.
What Is NOT Covered by This Limited Warranty?
This Limited Warranty does not apply to, and Seller will not be responsible for, any of the following:
- Improper installation, including but not limited to, failure to follow Seller's most current published installation instructions, specifications, surface preparation guidelines, or industry standard practices.
- Normal wear and tear, including gloss reduction, scratches, scuffs, or dulling of the finish.
- Faulty maintenance, lack of maintenance, or failure to maintain the Products according to Seller's recommendations.
- Misuse, abuse, neglect, or accidental damage.
- Exposure to extreme temperatures or conditions outside the Product's specified limitations.
- Staining, peeling, or other damage caused by:
- Cracking, movement, or defects in the substrate.
- Hydrostatic pressure, excessive moisture, or moisture vapor transmission rates exceeding the specified limits for a particular Product.
- Aggressive chemicals, solvents, battery acid, brake fluid, or other industrial fluids not intended for exposure to the Product, unless the Product is specifically designed for such exposure.
- Acts of God, casualty, or natural disasters.
- Damage or failure resulting from alterations or repairs not authorized by the Seller.
- Issues related to aesthetics, such as color variations from samples or minor surface imperfections that do not affect the Product's performance.
- Products not paid for in full.
Purchaser's Exclusive Remedy and Limitation on Liability.
The foregoing Limited Warranty will be the purchaser's sole and exclusive remedy against Seller, whether in contract, under statute (including provisions as to the conditions as to the quality or fitness for any particular purpose of goods supplied pursuant to the contract of sale), warranty, tort, strict liability, or any other legal theory.
DISCLAIMER
THIS EXPRESS LIMITED WARRANTY IS THE ONLY WARRANTY GIVEN BY SELLER WITH RESPECT TO ITS PRODUCTS. SELLER MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, AND HEREBY SPECIFICALLY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, WHETHER STATUTORY OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
Seller's liability to purchaser on any claim for loss or damage arising out of, connected with, or resulting from the Product hereunder shall not exceed the original purchase price of the Product determined to be defective. In no event shall Seller be liable for special, incidental, indirect, or consequential damages, including, but not limited to, injuries to persons or damage to property, loss of profits or anticipated profits, loss of use of any property, costs of removal or reinstallation of the Product, or labor costs.
How does state law relate to this warranty?
This Limited Warranty gives you specific legal rights, and you may also have other rights which vary from state to state (or province to province in Canada). Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
